Energy efficiency improvement of public buildings in Kremenchuk, including 38 kindergartens (38 facilities), 23 schools (23 facilities) and 5 hospitals (6 facilities)

This Invitation for Tenders follows the General Procurement Notice for Kremenchuk Public Buildings Energy Efficiency project (the Project) which was published in the Procurement Opportunities on 06 February 2018 under ref. No. 8966-GPN-48019 and updated on 23 August 2019 under ref. No. 9495-GPN-48019.

Communal Enterprise “Kremenchug Municipal Energy Service Company” of the Kremenchuk City Council of Poltava Region (the “Employer”), has received loans from the European Bank for Reconstruction and Development (the “Bank” or “EBRD”) and the EBRD Clean Technology Fund (“CTF”) and a grant from the EBRD Special Shareholders Fund (“SSF”) towards the cost of the Project.

The Employer now invites sealed tenders from contractors for the contracts (turnkey thermal modernisation of public buildings (Facilities) with predetermined targeted energy efficiency levels, Energy Performance Contracts or Contracts) listed below to be funded from the proceeds of the loans and the grant (each divided by two sub-lots). Sub-lots 1.1 and 2.1 will be financed from the proceeds of the loans and sub-lots 1.2 and 2.2 will be financed from the proceeds of the grant:

  • Lot / Contract 1 (for 33 Facilities aggregated in Lot 1 divided into sub-lots 1.1 and 1.2)
  • Lot / Contract 2 (for 34 Facilities aggregated in Lot 2 divided into sub-lots 2.1 and 2.2)

Tenders are invited for one or both lots.

The Tenderers shall submit the Tenders for both sub-lots within each lot. Failure to submit proposals for both sub-lots in each lot will result in the rejection of the Tender.

Tendering for contracts to be financed with the proceeds of the EBRD and the CTF loans and the SSF grant is open to firms from all countries. The proceeds of the EBRD and the CTF loans and the SSF grant will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations.

Tender Documents may be obtained by the Tenderers in electronic format free of charge upon request sent to the Employer’s e-mail address presented in this Invitation for tenders. Wherever the electronic version of selected parts of the document is provided in Word and PDF formats, in case of discrepancies between the two versions, the PDF version shall prevail.

A two-stage tender procedure will be adopted and will proceed as follows:

(a)        the First Stage tender will consist of a technical proposal only, without any reference to prices, and a list of any deviations to the technical and commercial conditions set forth in the tender documents or any alternative technical solutions a tenderer wishes to offer, and a justification therefore, provided always that such deviations or alternative solutions do not change the basic objectives of the project.

Together with the First Stage Tender the Tenderers will have to submit documentary evidence confirming their compliance with the qualification criteria to perform the Contract(s) using the relevant forms furnished in Volume I. iv: Tender Forms. The Employer reserves the right to waive any minor deviations from the qualification criteria specified in Volume I. iii: Evaluation and Qualification Criteria that do not materially affect the capability of the Tenderer to perform the Contract(s).

Following evaluation by the Employer of the First Stage tenders, the Employer will invite each tenderer who meets the qualification criteria and who has submitted a technically responsive tender to a clarification meeting. The proposals of all such tenderers will be reviewed at the meeting and all required amendments, additions, deletions and other adjustments will be noted and recorded in a Memorandum. Only qualified tenderers submitting a technically responsive and acceptable First Stage tender will be invited to submit a Second Stage tender.

(b)        the Second Stage tender will consist of an updated technical tender incorporating all changes required by the Employer as recorded in the Memorandum to the clarification meeting or as necessary to reflect any amendments to the tender documents issued subsequent to submission of the First Stage tender; and the commercial tender.

First Stage tenders must be delivered to the address below on or before 16:00 on 22 January 2020 at which time they will be opened in the presence of the tenderers’ representatives who wish to attend.

Tender Security is not required.

General Procurement Notice

Kremenchuk City Municipality (City) and Communal Enterprise “Kremenchug Municipal Energy Service Company” of the Kremenchuk City Council of Poltava Region, intend using the proceeds of a loan and a grant from the European Bank for Reconstruction and Development (the Bank or EBRD) and a loan from the Clean Technology Fund (CTF) to improve the energy efficiency of public buildings in Kremenchuk including 38 kindergartens, 23 schools and 5 hospitals. The proposed project, which has a total estimated value of EUR 10 million equivalent, will require the procurement of the following goods, works and services:

Energy efficiency improvement in public buildings, including the implementation of energy conservation measures, such as:

  • Thermal insulation of external walls, ceilings and attic basement floors;
  • Doors and windows replacement;
  • Heating and hot water pipes insulation;
  • Individual heat substations installation;
  • Heating systems renovation (balancing, installation of regulators and thermostatic valves);
  • Heating systems modernization;
  • Ventilation systems renovation with heat recuperation;
  • Other, as appropriate.

The contact will include the following activities:

  • Preparation of design for energy conservation measures;
  • Implementation of energy conservation measures;
  • Provision of a performance guarantee (energy savings) with maximal duration of two heating seasons (guaranteed period);
  • Monitoring, measurement and verification of achieved savings;
  • Maintenance of implemented energy conservation measures during the guarantee period.

The tendering for the above contracts is expected to commence in the fourth quarter of 2019.

Contracts to be financed with the proceeds of a loan and a grant from the Bank and a loan from CTF will be subject to the EBRD Procurement Policies and Rules and will be open to firms from any country. The proceeds of the Bank’s loan will not be used for the purpose of any payment to persons or entities, of for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or under a law of official regulation of the Purchaser’s country.

First stage of the tendering for Kremenchuk Public Buildings Energy Efficiency Project.

On the May 14th, Communal Enterprise «Kremenchuk Municipal Energy Service  Company»  announced the commencement of the acceptance of the documents for participation in the first stage of the tendering for Kremenchuk Public Buildings Energy Efficiency Project.

The Project will be  financed by the European Bank for Reconstruction and Development, EBRD Clean Technology Fund loans and a grant from the EBRD Special Shareholders Fund, and is aimed at the technological and thermal upgrading of 38 kindergartens, 23 schools and 5 city hospitals.

The implementation of the Project will substantially improve the technical condition of these facilities, which will significantly increase the energy efficiency of the city structure and cost saving.

Only nine prequalified companies will take part in tendering.

Attraction of external investments in energy saving

In today’s context there is a lack of local government self-government resources, in particular for infrastructure development projects. In view of this, the role of external borrowing from international financial institutions (IFIs) and foreign state financial institutions substantially increases. They have the opportunity and desire to finance local development projects and are a reliable source for the development of local infrastructure. Unlike Ukrainian lending banks, the cost of borrowing from such lenders is significantly lower, and the timing is longer. As a result, borrowing from the IFIs and foreign state financial institutions in modern terms is a real source of financing for urban infrastructure development projects.
In accordance with the second paragraph of Article 16 of the Budget Code, local external loans can be made by all city councils by obtaining loans (loans) from international financial organizations.

Statute of the enterprise

According to the Charter of the communal enterprise “Kremenchug Municipal Energy Service Company” of the Kremenchug City Council of the Poltava region, its owner and founder is the territorial community of Kremenchuk in the person of the Kremenchug city council of the Poltava region.
The enterprise is functionally subordinated to the authorized management body – the department of energy management and energy of the executive committee of the Kremenchug city council of the Poltava region.

Project “Improving Energy Efficiency of Public Buildings in Kremenchuk”


The enterprise is the responsible executor of the project “Energy efficiency improvement of public buildings in Kremenchug” in accordance with the decision of the Kremenchug city council of Poltava region dated 21.12.2017 “On approval of the project ” Increasing the energy efficiency of public buildings in Kremenchug “, the purpose of communal the Kremenchug Municipal Energy Service Company , responsible executor and assent to the conclusion of a loan agreement with the European Bank for Reconstruction and Development under the the Kremenchug City Council and the conclusion of a grant agreement »
The decision of the Executive Committee No. 48 dated January 22, 2018 “On approval of the conclusion on the appropriateness of attracting a loan from the European Bank for Reconstruction and Development for the implementation of the project” Improving the energy efficiency of public buildings in Kremenchuk “under the guarantee of the Kremenchug city council of Poltava region”, the conclusion was approved the expediency of attracting a loan from the EBRD for the implementation of this Project under the guarantee of Kremenchug city council.
The overall objective of this Project is to implement energy saving (EEZ) measures aimed at reducing energy consumption and maintenance and maintenance costs (ETO) as well as reducing CO2 emissions, which selected 66 budget objects (38 kindergartens , 22 schools, 5 hospitals and the House of children and youth creativity). In addition, the project should improve the conditions for studying and staying in school classes for more than 17,000 students, 7,000 children in kindergartens, as well as the conditions for heating and a comfortable indoor climate for medical institutions for 2 400 patients a day.
